These terms are an agreement between you and VoidMarch Games L.L.C. ("we", "us") for your use of VoidMarch on iOS, Android and the web. By creating an account you agree to these terms, including the Community Rules, which cover behavior and fair play, and the Credits and Refunds terms. Both are part of these terms. The Privacy Policy explains how we handle your information.

Who can play

  • You must be at least 13 years old and provide your age group before entering the game. Give accurate information; do not use another account or a false age to avoid a restriction.
  • If you are under 18, your parent or guardian must review and agree to these terms on your behalf.
  • Additional age or parental-consent checks may apply where required. Until a required check is completed, the affected access or purchase may be unavailable. Contact support if you believe a restriction is incorrect.
  • VoidMarch is offered in the United States only. You may not use it where it isn't offered or where the law doesn't allow it, including if you are subject to sanctions that prohibit it.
  • You may have one commander per universe, as described in the Community Rules.

Communication and age protections

We may limit some features for players known to be under 18, including player-to-player direct messages, external GIF alliance banners and chat in an alliance with fewer than three eligible members. These limits are not a guarantee that anyone is supervising a conversation.

Your account

  • Choose a commander name that follows the Community Rules. We may change a name that doesn't.
  • Keep your password private. You are responsible for activity on your account.
  • Your account is personal. You may not sell, transfer or share it.

How the game works

  • VoidMarch is a persistent universe. Production, construction and fleets continue while you are offline, and other players can attack you. Losing ships, resources or planets in play isn't a fault in the service.
  • Battle simulators, previews and estimates in the game are guides, not guarantees.
  • We change the game over time, including balance, rules, features and prices in Credits.
  • The service can be interrupted by maintenance, outages or errors. If an error corrupts the game state, we may correct or restore it, which can undo recent progress.
  • We may end a universe or the whole game. Purchases are final. We do not promise a refund or compensation for unused Credits if a universe or the game closes, except where required by applicable law or the store’s rules.

Content you create

"Your content" means chat messages, names, alliance descriptions and anything else you create in the game.

  • You keep any rights you have in your content.
  • You give us a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to host, store, copy, display and distribute your content as needed to run, moderate and improve the game.
  • You are responsible for your content, and you confirm you have the right to post it.
  • Other players can see content you post in world chat, on the community board, on alliance pages and in names.

Feedback

"Feedback" means support tickets, bug reports, suggestions, screenshots and anything else you send us about the game. You give us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive, transferable and sublicensable license to use, copy, modify, publish and otherwise exploit your feedback for any purpose, without compensation or attribution to you. We may keep feedback after your account is deleted, as described in the Privacy Policy.

Rules and enforcement

You agree to follow the Community Rules. We may remove content, restrict features, suspend your account or close it if you break the Community Rules or these terms, if we believe you aren't playing within the spirit of the game, or if we believe it's necessary to protect other players, the game's operation, profitability or continuity, or us. We decide these matters at our sole discretion.

If a purchase is refunded, we may reverse the refunded Credits and associated bonus. If already spent, they become Credit debt as described in Credits and Refunds.

Credits and in-game items

Credits, resources, ships, planets and other in-game items are game-related digital content. You have a limited, personal, non-transferable, revocable license to use them in the game. They aren't your property, aren't money, a deposit or stored value, have no cash value, and can't be exchanged or redeemed for money or anything outside the game, or transferred outside the game, except where applicable law or the store's rules require otherwise.

Credits are available as optional purchases in the iPhone and iPad app through the App Store and in the Android app through Google Play. The Credits and Refunds terms describe purchases, bonuses and refund handling.

Our software and artwork

VoidMarch, its software, artwork, text and names belong to us or our licensors. We give you a limited, personal, non-transferable, revocable license to use the game for your own non-commercial play, following these terms. You may not:

  • copy, sell or distribute the game;
  • use bots, scripts or modified clients;
  • access the game except through our apps and website;
  • collect data about other players; or
  • interfere with our servers.

The Community Rules explain these limits in more detail.

Third-party software and fonts are subject to their respective licenses, provided in our Third-party notices and in the app under Help → Legal. Nothing in these terms limits rights granted to you under those licenses. If these terms conflict with a third-party license, that license controls for the component it covers.

Which terms apply

These terms, together with the Community Rules and the Credits and Refunds terms, are the entire agreement between you and us about VoidMarch. On iOS, these terms are our custom end user license agreement and apply instead of Apple’s standard Licensed Application End User License Agreement. On Android, these terms are our end user license agreement for the app.

If documents conflict, the following order applies, highest first:

  1. applicable law that can’t be changed by agreement;
  2. for the iOS app, the Apple App Store terms below; for the Android app, any provision of Google’s agreement with us that Google requires to control over a developer’s end user terms;
  3. these terms;
  4. the Credits and Refunds terms;
  5. the Community Rules;
  6. any other in-game rules, notices or event terms.

Third-party software licenses control for the components they cover, as described in "Our software and artwork".

Purchases through the App Store or Google Play are also subject to the terms between you and Apple or Google for that purchase, including their refund policies. We aren’t a party to those terms. Nothing in these terms limits a refund or other right that Apple or Google gives you, or the store rules that apply to us.

Apple App Store terms

This section applies if you downloaded the app from the Apple App Store. "Apple" means Apple Inc.

  • Agreement with us, not Apple. You and we acknowledge that these terms are concluded between you and VoidMarch Games L.L.C. only, and not with Apple. We, not Apple, are solely responsible for the app and its content. These terms do not provide usage rules for the app that conflict with the Apple Media Services Terms and Conditions or the Volume Content Terms.
  • Scope of license. Your license to use the app is a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you through Family Sharing, volume purchasing or Legacy Contacts where Apple allows it. This license is subject to the other limits in these terms.
  • Maintenance and support. We are solely responsible for providing any maintenance and support services for the app, as specified in these terms or as required by applicable law. You and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services for the app.
  • Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our sole responsibility.
  • Product claims. You and we acknowledge that we, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation. These terms do not limit our liability to you beyond what is permitted by applicable law.
  • Intellectual property claims. If a third party claims that the app or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of that claim.
  • Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Contact. Direct any questions, complaints or claims about the app to VoidMarch Games L.L.C., 1500 N GRANT ST STE N, Denver, Colorado 80203, United States; telephone (719) 286-9278; email support@playvoidmarch.com.
  • Third-party terms. You must comply with applicable third-party terms of agreement when using the app, for example your wireless data service agreement.
  • Third-party beneficiary. You and we acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these terms. On your acceptance of these terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these terms against you as a third-party beneficiary.

Ending this agreement

  • You can stop playing at any time and delete your account as described on the account deletion page.
  • We can suspend or close your account as described above, or end the game subject to applicable obligations.
  • When your account is deleted or closed, including for a rule violation, you lose access to your commander and any unused Credits. Purchases are final and unused Credits are not refunded, except where required by applicable law or the store’s rules.
  • Sections that by their nature should continue, such as the licenses you give us and applicable store obligations, continue after this agreement ends.

Disclaimers

VoidMarch is provided "as is" and "as available". To the extent the law allows, we don't promise that the game will be uninterrupted, error-free or available in any particular form. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from the game or these terms. Our total liability to you for all claims relating to the game or these terms is limited to the greater of $50 or the amount you paid for Credits in the 12 months before the claim arose.

These limits don't apply to liability that the law doesn't allow us to limit, including liability for our fraud, gross negligence or willful misconduct.

Claims caused by you

To the extent the law allows, you agree to cover our reasonable losses and costs, including reasonable legal fees, from claims by others to the extent they arise from your misuse of the game, your material breach of these terms or unlawful content you post.

Governing law and disputes

  • Governing law. These terms, and any dispute, claim or controversy arising out of or relating to these terms, VoidMarch, the app, the service, Credits or your account (a "Dispute"), are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules, and applicable federal law of the United States. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
  • Courts. Except as provided under "Small claims", any Dispute between you and VoidMarch Games L.L.C. must be brought exclusively in the state courts located in the City and County of Denver, Colorado, or the United States District Court for the District of Colorado. You and we consent to the personal jurisdiction of, and venue in, those courts and waive any objection to them, including any objection based on inconvenient forum.
  • Small claims. Either of us may instead bring an individual Dispute in a small claims court located in the City and County of Denver, Colorado, if the Dispute qualifies for and remains in that court.
  • No arbitration. Disputes will be resolved in court as described above and not by arbitration. No informal dispute process is required before either of us files.
  • Your non-waivable rights. This section does not deprive you of the protection of any law of the place where you live that can’t be waived by contract. If a court finds that the "Courts" paragraph can’t be enforced for a particular Dispute, that Dispute may proceed in a court that has jurisdiction, and the rest of this section continues to apply.
  • Apple. This section governs Disputes between you and us. It does not limit Apple’s rights as a third-party beneficiary under the Apple App Store terms above.

Changes to these terms

We may update these terms. Updates take effect when we post them with a new date. For material changes, we'll ask you to accept the updated terms before you continue playing. If you don't accept, you can delete your account.
